E-Bike Laws in Australia
Ride Smarter. Ride Legally.
Electric bikes are one of the best ways to get around Australia, but it’s important to understand the rules before you ride.
While regulations vary slightly between states and territories, most Australian road rules are based on the same national framework. Understanding these rules helps keep you safe, protects other road users, and ensures your bike remains compliant.
At Ampd Bros, we design our electric bikes with Australian regulations in mind and encourage all riders to stay informed about the laws in their local area.
What Is a Legal Electric Bike in Australia?
For an electric bike to be used on public roads, shared paths and cycleways in Australia, it generally must fit into one of the following categories:
Pedal Assist Electric Bikes (Pedelecs)
A pedal assist electric bike provides motor assistance only while you are pedalling.
To be road legal in Australia, the bike must:
✔ Have a maximum continuous rated motor output of 250 watts
✔ Meet European Standard EN15194
✔ Motor assistance must progressively reduce and cut out at 25km/h
✔ Require pedalling for motor assistance
Throttle Controlled Electric Bikes
For EN15194-compliant electric bikes, throttle control is only permitted up to 6km/h. This is typically used as a walk-assist or low-speed start-assist function.
A throttle that can power the bike above 6km/h without pedalling is not legal for use on public roads, bike paths or shared paths in Australia.
Throttle systems capable of speeds above 6km/h are intended for private property use only and should not be used in public areas.
Key Points
✔ EN-compliant throttle assist: up to 6km/h only
✔ Pedal assist must cut out at 25km/h
✔ Throttle above 6km/h: private property only
✔ Riders are responsible for using the correct mode for their riding location
Understanding Speed Limits
One of the most common misconceptions about electric bikes is that there is a strict speed limit on the bike itself.
In reality:
Legal Pedal Assist Speed
For road-legal pedal assist bikes:
- Motor assistance must stop at 25km/h
- Riders can travel faster than 25km/h using their own pedalling effort or while travelling downhill
- The restriction applies to motor assistance, not overall bike speed
Private Property & Off-Road Use
Some electric bikes are capable of speeds beyond public-road limits when configured for private property or approved off-road use.
These configurations may not be legal for use on:
- Public roads
- Shared paths
- Bike lanes
- Public parks
Always check your local regulations before riding.
Where Can I Ride My Electric Bike?
In most Australian states, compliant electric bikes may be ridden anywhere a standard bicycle is permitted, including:
✔ Bike paths
✔ Shared pedestrian/cycle paths
✔ Dedicated bicycle lanes
✔ Public roads
✔ Local streets
However, local councils and state authorities may impose additional restrictions in certain areas.
Always obey local signage.
Helmet Requirements
Helmets are mandatory throughout Australia.
When riding an electric bike you must wear:
✔ An approved Australian Standards bicycle helmet
✔ The helmet must be securely fastened
Failure to wear a helmet may result in fines and significantly increases the risk of serious injury.
Passenger Rules
Many Ampd Bros models are designed with passenger carrying capability.
However, passenger regulations vary between states.
Generally:
✔ The bike must be designed to safely carry a passenger
✔ The passenger should have an appropriate seat
✔ Foot pegs or footrests should be fitted
✔ Maximum weight ratings must not be exceeded
Always check your state’s specific requirements before carrying a passenger.
Lighting Requirements
If riding at night or in low visibility conditions, your bike should be equipped with:
✔ White front light
✔ Red rear light
✔ Rear reflector
✔ Amber Side Reflectors in wheels & pedals
✔ Functional brakes
Many Ampd Bros models come equipped with integrated lighting systems to improve visibility and safety.
Riders Under 16
Rules regarding young riders can vary by state and territory.
Parents should ensure:
- The rider can safely control the bike
- The bike is appropriately sized
- All helmet requirements are met
- Local regulations are followed
Adult supervision is recommended for younger riders.
Off-Road Riding
Many Ampd Bros riders enjoy exploring beaches, trails, farms and private property.
Before riding off-road:
- Confirm access is permitted
- Respect local land management rules
- Follow any National Park restrictions
- Ride responsibly around other trail users
- Leave no trace
Modifying Your E-Bike
Modifying an electric bike may affect its legality.
Changes such as:
- Increasing motor output
- Removing speed restrictions
- Installing non-compliant throttle systems
- Altering factory electrical systems
may make the bike unsuitable for use on public roads.
If you’re considering modifications, contact the Ampd Bros team first for advice.
Ride Responsibly
Owning an electric bike comes with the same responsibility as any other vehicle.
We encourage every rider to:
✔ Follow local road rules
✔ Ride courteously around pedestrians
✔ Obey speed limits
✔ Wear protective equipment
✔ Regularly maintain their bike
✔ Respect local communities and shared spaces
