Ampd Bros General Giveaway Terms and Conditions

These General Giveaway Terms and Conditions apply to giveaways conducted by The Trustee for Keats Family Trust trading as Ampd Brothers, ABN 60 163 606 913, of 67 Dover Drive, Burleigh Heads QLD 4220 (“Ampd Bros”, “we”, “our” or “the Promoter”).

Each giveaway is also subject to the specific prize, dates, entry instructions and other information published on the applicable Ampd Bros giveaway page or official promotional announcement (“Giveaway Details”).

The Giveaway Details and these General Terms together form the complete terms of the applicable giveaway.

1. Promotional Period

The promotional period begins and ends on the dates and times stated in the applicable Giveaway Details (“Promotional Period”).

Entries received before or after the Promotional Period will not be accepted.

Unless otherwise stated, all times are Australian Eastern Standard Time (“AEST”).

2. Eligibility

Entry is open to Australian residents aged 16 years or older at the time of entry, subject to any state or territory exclusions stated in the Giveaway Details.

Employees, contractors and immediate family members of Ampd Bros, participating promotional partners and agencies directly involved in conducting the giveaway are not eligible to enter.

Ampd Bros may require reasonable proof of an entrant’s identity, age, residency and eligibility before awarding a prize.

3. Entrants under 18

An entrant aged 16 or 17 must obtain permission from their parent or legal guardian before entering.

If an entrant aged 16 or 17 is selected as the provisional winner, they must provide Ampd Bros with written consent from their parent or legal guardian before the prize can be awarded.

The written consent must:

confirm that the parent or legal guardian permitted the entrant to enter;
confirm acceptance of these Terms and Conditions;
authorise the entrant to receive and use the prize; and
include the parent or legal guardian’s full name, signature and contact details.

Ampd Bros may require reasonable evidence of the parent or legal guardian’s identity and relationship to the entrant.

The parent or legal guardian may be required to accept delivery, sign collection or delivery documents and assume responsibility for the minor’s safe and lawful use of the prize.

4. How to enter

Entry is free. No purchase or entry fee is required.

Entrants must follow the entry instructions stated in the applicable Giveaway Details and submit their entry during the Promotional Period.

Unless otherwise stated in the Giveaway Details, each person may submit one base entry per giveaway.

Entries must be submitted using accurate information belonging to the entrant. Entries submitted using multiple identities, false information, automated systems or fraudulent methods are invalid.

Incomplete, late, illegible, automated or fraudulent entries may be disqualified.

5. Bonus entries

Where bonus entries are available, the actions and number of entries awarded will be stated in the Giveaway Details.

Bonus actions are optional unless expressly identified as a required entry condition.

Bonus actions must be completed genuinely during the Promotional Period. Ampd Bros may request reasonable evidence that an action was completed.

Self-referrals, fictitious referrals, duplicate accounts, automated activity and unsolicited bulk messaging are prohibited. Entries obtained through those methods may be removed.

6. Winner selection

Unless the Giveaway Details state that the winner will be selected based on skill, winners will be selected by a random electronic draw from all valid entries.

Valid bonus entries will be included separately in the draw and will increase an entrant’s chances of winning.

The draw will take place on the date stated in the Giveaway Details or, if no draw date is stated, within five business days after the Promotional Period closes.

Each selected entrant is a provisional winner until Ampd Bros verifies their entry and eligibility.

The Promoter’s decision is final, subject to applicable law.

7. Winner contact and announcement

Ampd Bros will contact the provisional winner using the nominated telephone number and/or email address supplied with their entry.

Entrants are responsible for providing accurate contact information and monitoring their telephone, voicemail, email inbox and junk-mail folder.

Once verified, the winner will be announced on Ampd Bros’ official social-media accounts, @ampdbros.

The announcement may include the winner’s name or social-media handle and their state or territory. Ampd Bros will not publicly disclose the winner’s telephone number, email address or street address.

8. Claiming the prize

The provisional winner must respond to Ampd Bros and begin the verification process within five business days after Ampd Bros first attempts to contact them.

The provisional winner must provide any reasonably requested evidence of their identity, age, residency, eligibility and valid entry.

A provisional winner aged 16 or 17 must also provide the written parental or guardian consent required under these Terms.

If the provisional winner does not respond within five business days, is ineligible, cannot provide the required information or submitted an invalid entry, the prize may be treated as unclaimed.

Ampd Bros will not forfeit, reallocate or redraw an unclaimed prize earlier than permitted under applicable laws or permit conditions.

9. The prize

The prize and its recommended retail value will be described in the Giveaway Details.

The prize cannot be transferred or exchanged for cash, credit or another product at the winner’s request.

Images used in promotional material are illustrative. Minor differences in colour, specifications or appearance may occur.

If the advertised prize becomes unavailable for reasons beyond Ampd Bros’ reasonable control, Ampd Bros may substitute a prize of equal or greater value, subject to applicable laws and any required regulatory approval.

Unless expressly included in the Giveaway Details, registration, licensing, insurance, safety equipment, servicing, maintenance and operating costs are the winner’s responsibility.

Nothing in these Terms excludes any rights or consumer guarantees that cannot lawfully be excluded under the Australian Consumer Law.

10. Delivery and collection

Standard delivery is included to an accessible street address within an Australian metropolitan delivery area serviced by Ampd Bros’ usual freight carriers.

Regional, rural, remote, island and access-restricted locations may incur additional freight, ferry or special-handling charges.

Ampd Bros will cover the amount equivalent to standard metropolitan delivery. The winner will be responsible only for additional carrier charges above that standard delivery cost.

Any additional amount will be based on the applicable carrier quotation and disclosed to the winner in writing before dispatch.

The winner may instead arrange collection from Ampd Bros at 67 Dover Drive, Burleigh Heads QLD 4220, or another location agreed in writing.

For a winner aged 16 or 17, delivery or collection must be accepted by their parent or legal guardian.

11. Safe and lawful use

The winner is responsible for using the prize safely, lawfully and in accordance with the manufacturer’s instructions.

Where the prize is an electric bike or other mobility product, the winner is responsible for complying with applicable riding, road, registration, licensing, age, helmet and safety requirements in their location.

12. Personal information

Ampd Bros collects entrants’ personal information to administer the giveaway, validate entries, contact winners, announce results, deliver prizes and comply with legal obligations.

Personal information will be handled in accordance with the Ampd Bros Privacy Policy available on the Ampd Bros website.

Information may be provided to competition-platform providers, delivery providers, professional advisers, regulators and named promotional partners where reasonably necessary to administer the giveaway.

Marketing consent will be obtained separately where required. Entrants who consent to receive Ampd Bros marketing may unsubscribe at any time.

13. Social-media platforms

Ampd Bros giveaways are not sponsored, endorsed, administered by or associated with Facebook, Instagram, TikTok, YouTube or any other social-media platform unless expressly stated otherwise.

Entrants release those platforms from liability associated with the giveaway to the extent permitted by law.

Entrants must comply with the applicable platform’s terms and community guidelines when completing entry actions.

14. Events outside Ampd Bros’ control

Ampd Bros is not responsible for entries that are lost, delayed or not received because of a technical failure outside its reasonable control.

If fraud, tampering, technical failure, disaster or another event beyond Ampd Bros’ reasonable control prevents a giveaway from operating fairly or as intended, Ampd Bros may suspend, modify or cancel the giveaway to the extent reasonably necessary, subject to applicable laws and regulatory approval.

Notice of a material change will be published through the Ampd Bros website or official social-media accounts where reasonably practicable.

15. Applicable laws

All giveaways are conducted subject to applicable Commonwealth, state and territory laws.

Ampd Bros will obtain any permit or authority required for a particular giveaway. Any applicable permit number or geographic exclusion will be stated in the Giveaway Details.

These Terms are governed by the laws of Queensland, Australia, without limiting any rights an entrant may have under the laws applying in their state or territory.
